深圳市獵芯科技有限公司（以下簡(jiǎn)稱(chēng)“獵芯”）有關(guān)進(jìn)口芯片的銷(xiāo)售政策充分遵守從事全球貿(mào)易的國(guó)家所管理的所有相關(guān)法律和法規(guī)。為更好地維護(hù)獵芯與您或您所在企業(yè)的長(zhǎng)期合作友好關(guān)系，特對(duì)獵芯公司向您及您所在企業(yè)所售的有關(guān)進(jìn)口芯片的使用事宜，作出特別聲明如下：

請(qǐng)您及您所在企業(yè)在使用、銷(xiāo)售、出口、再出口或者轉(zhuǎn)讓自獵芯購(gòu)買(mǎi)的進(jìn)口芯片時(shí)，請(qǐng)嚴(yán)格遵守美國(guó)進(jìn)出口管制的法律法規(guī)。特此提示如不遵守美國(guó)出口管制法律和貿(mào)易法規(guī)可能會(huì)對(duì)您個(gè)人或您所在企業(yè)造成民事和刑事處罰，如因貴方不遵守美國(guó)出口管制法律法規(guī)產(chǎn)生的一切損失及其他法律后果，將由您或您所在企業(yè)自行承擔(dān)；如因貴方違反上述規(guī)定的行為給獵芯造成損失，我們將依法追責(zé)。具體而言，請(qǐng)您及您所在企業(yè)在使用、銷(xiāo)售、出口、再出口或者轉(zhuǎn)讓自獵芯公司購(gòu)買(mǎi)的進(jìn)口芯片時(shí)，謹(jǐn)遵如下約定：

1. 不向任何被指定支持恐怖主義或受到美國(guó)全面貿(mào)易制裁的國(guó)家或地區(qū)（含克里米亞、古巴、伊朗、朝鮮、蘇丹、敘利亞、俄羅斯、白俄羅斯以及后續(xù)增加的任何國(guó)家或者地區(qū)）銷(xiāo)售、出口來(lái)自獵芯的進(jìn)口芯片或者包含獵芯公司進(jìn)口芯片的管制物品；

2. 不向美國(guó)政府各項(xiàng)禁止清單（含各類(lèi)實(shí)體清單及SDN清單）上的任何個(gè)人或?qū)嶓w銷(xiāo)售、出口來(lái)自獵芯的進(jìn)口芯片或者包含獵芯公司進(jìn)口芯片的管制物品；

3. 不得將獵芯公司的進(jìn)口芯片產(chǎn)品用于禁止被使用的最終用途的個(gè)人或?qū)嶓w，包括與核武器、化學(xué)或生物武器的研發(fā)、設(shè)計(jì)、制造、建造、操作或維護(hù)有關(guān)的活動(dòng)，或者任何軍事終端用戶(hù)。

重要聲明：請(qǐng)您及您所在企業(yè)遵守執(zhí)行，如有違背上述之事項(xiàng)，獵芯公司將有權(quán)隨時(shí)終止雙方的合作及服務(wù)而不作任何預(yù)先通知。感謝您的配合與支持！

————————————————————It is ICHUNT’s policy to comply fully with all relevant laws and regulations administered by the countries in which  ICHUNT conducts global trade. Under no circumstances will ICHUNT sell or ship product contrary to applicable export control laws and trade regulations. In view of the particularity of the goods ICHUNT sells， we make a special statement as follows：ICHUNT’s distributors, resellers, customers, and end-users are responsible for compliance with U.S. export control and import laws and regulations when exporting, re-exporting, importing, or otherwise transferring any ICHUNT products or technology, including products derived from or based on such technology (collectively, “ICHUNT Products”). These laws impose restrictions on the shipment or transfer of ICHUNT Products to certain countries and persons, and/or on the ultimate end-uses of such products. It is your responsibility to be aware of applicable export control and import restrictions and comply with them. ICHUNT assumes no responsibility or liability for your failure to comply. Failure to comply with U.S. and non-U.S. export control laws and trade regulations can result in civil and criminal penalties to individuals and businesses.  If your behavior cause losses to ICHUNT ,we will claim compensation from you.By purchasing, selling, using, or otherwise transferring ICHUNT Products you agree to comply with all applicable export and reexport control laws and regulations, including the U.S. Export Administration Regulations (“EAR”), administered by the U.S. Department of Commerce’s Bureau of Industry and Security (“BIS”), the International Traffic in Arms Regulations administered by the U.S. State Department’s Directorate of Defense Trade Controls, and trade sanctions administered by the Treasury Department’s Office of Foreign Assets Control (“OFAC”). Specifically, you agree that you will not, directly or indirectly, without any required government authorization, sell, export, reexport, transfer, divert, or otherwise dispose of any ICHUNT’s Products to:

1.  any country or territory that is not authorized to receive the ICHUNT’s Products based on their applicable licensing jurisdiction and export control classification;

2. any country or territory that is a designated state sponsor of terrorism or subject to comprehensive U.S. trade sanctions (including Entity List, Specially Designated National or any other sanction list, currently include Crimea, Cuba, Iran, North Korea, Sudan, Syria,Russia, Ukraine and any country added subsequently);

3. any person or entity on a U.S. Government list of prohibited persons, including but not limited to the Specially Designated Nationals and Blocked Persons List, Sectoral Sanctions Identifications List, and Foreign Sanctions Evaders List, administered by OFAC; and the Denied Persons List, Entity List, and Unverified List, administered by BIS;

4.  any person or entity with knowledge or reason to know that ICHUNT’s Products will be used for a prohibited end use, including activities related to the research, development, design, manufacture, construction, operation or maintenance of nuclear, chemical, or biological weapons; 

5.  any “military end user” or any person or entity with knowledge or reason to know that ICHUNT’s Products will be used for a “military end use,” as defined and subject to the license requirements in Section 744.21 of the EAR; or any military-intelligence end user,as defined and subject to the license requirements in Section 744.22 of the EAR

Important announcement: The Company reserves the right to terminate the Service and this agreement without prior notice in case the Client is in breach of any of the terms hereof.
